Petitioner apprehends his arrest in connection with Baligaon P.S. Case No. 55 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 307, 353, 331, 333, 334, 337, 338, 379, 504, 506 of the Indian Penal Code, 27 of the Arms Act and Sections 5/6 of E.S.M. Act. Allegation against the petitioner and one Sanjay Sah is of assault to the S.H.O. of Police of Baligaon Police Station. Submission of learned counsel for the petitioner is that no specific allegation has been attributed against him rather against Sanjay Sah and injuries are simple in nature. Moreover, Sanjay Sah has been granted privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 19.12.2017 passed

Having heard both sides and in the facts and circumstances, let petitioner surrender within a period of four weeks from the receipt of this order and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Baligaon P.S.Case No. 55 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that petitioner has to cooperate in investigation, otherwise prosecution is given liberty to move for cancellation of his bail bond.
