2. Petitioner apprehends arrest in a case registered for the offence punishable under section 147, 148 , 149, 341 , 323 , 325 , 307, 379, 332, 333 , 353 and 427 of the Indian Penal Code .

As per the prosecution case , on the alleged date and time of occurrence , informant along with police officials was on patrolling duty , and when they reached near the leprosy hospital located in Chotki Nawada, at the same time , a sandloaded tractor was coming from the Ramshila side along with a trailer, and after seeing the police party, they tried to escape by hitting the police vehicle . It is further alleged that while saving himself from the tractor, the driver of the police vehicle turned

No.83795 of 2024(4) dt.18-03-2025 2/2 the police vehicle aside, and by chasing the tractor, two persons were caught, and the tractor was taken into possession by the police party. In the meanwhile, 40 to 50 persons reached the place of occurrence and started pelting stones on police, due to which police personnel sustained injury, and accused persons also attempted to release the seized tractor and damaged the police vehicle. It is further alleged that somehow the accused persons became successful in escaping along with the tractor bearing registration No. BR-02bG-6029 and also got the apprehended persons released from police custody .

Considering the fact that petitioner being a member of mob attacked on police party due to which some police personnel sustained injuries and they also became successful in releasing the seized tractor and also released the apprehended persons from police custody and other circumstances of the case , prayer for pre-arrest bail of the petitioner is rejected.
