JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2018 Petitioners apprehend their arrest in connection with Madanpur P.S.Case No. 129 of 2016 registered for the offences punishable under Sections 409, 420 and 34 of the Indian Penal Code.
Allegation against the petitioners is of defalcation of Rs.4,95,000/- which was sanction for construction of school building.
Submission of learned counsel for the petitioners is that though construction has been completed but they are ready to deposit the amount if reasonable time is granted to them. Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.7938 of 2018 (3) dt.19-06-2018 2/2 circumstances, this application is disposed of with a direction to the petitioners to surrender within a period of 12 weeks along with a Bank Draft for Rs.4,95,000/- in favour of the authority concerned and if he has done so, the petitioner will be released on bail to the satisfaction of the court concerned itself. In the meantime, for the period of 12 weeks, no coercive step shall be taken against the petitioners.
