2. With the consent of both the parties, this writ application is being disposed of at this stage itself.

3. In the present writ application, the petitioner has prayed for the grant of following reliefs:

(i) For direction upon the respondents authorities concerned to grant and pay interest @ Rs.18% per annum to the petitioner on the total amount Rs. 2,37,657/- (Rupees Two Lakhs Thirty Seven Thousand

2/4 Six Hundred Fifty Seven only) paid in the light of the order dated 30.10.2006 passed in C.W.J.C. No. 15552 of 2005, the said amount has been paid after about 14 years of delay as such the petitioner is entitled for interest due to delayed payments of arrears of salary and various allowances though this Hon'ble Court has given liberty to the petitioner to ventilate his grievances as per law vide his order dated 17.07.2009 passed in M.J.C. No. 2516 of 2007 but despite representation filed by the petitioner the respondents have not taken into considerations so far.

(ii) For further direction upon the respondents authorities concerned to grant any such other reliefs or reliefs for which the petitioner is found legally entitled in the fact and circumstances of this case.

After advancing some argument, learned counsel for the petitioner submits that for the reliefs claimed for in the present writ application, the petitioner is prepared to file a fresh detailed representation before the respondent no. 4 i.e. the Director, Secondary Education Department, Government of Bihar, Patna within one month from today. Learned counsel for the petitioner further prays that if such a representation is filed

3/4 within the stipulated time then the Director, Secondary Education Department, Government of Bihar, Patna may be directed to dispose of the representation filed by the petitioner on merit within a fixed time frame after giving an opportunity of hearing to the petitioner.

5. To the aforesaid prayer being made by learned counsel for the petitioner, learned counsel appearing for respondent-State does not have any objection.

Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of granting liberty to the petitioner to file a detailed representation before the Director, Secondary Education Department, Government of Bihar, Patna within one month from today and if such a representation is filed then the Director, Secondary Education Department, Government of Bihar, Patna is directed to dispose of the same on merit within a further period of three months from the date of receipt of the representation after giving an opportunity of hearing to the petitioner, by passing a reasoned and speaking order. In case, the petitioner is found entitled to the relief, the same should be extended to the petitioner within a further period of three months from the date of passing of the final order.

7. With the aforesaid observation/direction and liberty granted, this writ application is disposed of. All pending interlocutory application(s), if any, shall also be deemed to have been disposed of.
