The petitioner seeks bail in connection with Akilpur P.S. Case No. 57 of 2025 instituted for the offence under Sections 191(2), 190, 126(2), 115(2), 118(1), 109, 76, 303(2), 324(4), 324(5), 352, 351(2) & 351(3) of the Bharatiya Nyaya Sanhita, 2023.

Prosecution case, in short, is that on 19.05.2025 at about 7:20 PM, while the informant was returning home with her son Sunny Kumar, a group of accused persons armed with weapons assaulted his son, when informant resisted the snatching of his cash bag. Some accused dragged the informant to a maize field, tore her clothes, outraged her modesty, and

Patna High Court CR. MISC. No.77071 of 2025(2) dt.18-11-2025 2/3 inflicted a knife injury on her stomach, while her husband was also assaulted. They allegedly snatched Rs. 50,000/- and a Jitiya, threatened to kill the family.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.06.2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is named in the FIR. There is no specific allegation against the petitioner, rather the same is general and omnibus in nature, which is evident from bare perusal of the FIR itself. Specific allegation is against co-accused, Vinay. Nothing has been recovered from the conscious possession of the petitioner. It is lastly submitted that the present case is the counter blast of the earlier case lodged by the petitioner's side bearing Akilpur PS Case No. 53 of 2025.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no specific allegation against the petitioner and charge sheet being

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Akilpur P.S. Case No. 57 of 2025.
