Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109(1), 352, 351(2), 303(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is aged about 70 years and the informant alleges that on 26-7-2025, he was getting his land ploughed, when the accused persons including the petitioner came and started abusing and petitioner gave orders to Vikash to kill the informant, thereafter Vikash assaulted him by kudal causing injury on head and he fell, when both assaulted him and Vikash took Rs. 4,500/- from his pocket.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that petitioner is aged about 70 years and has remained a person with clean antecedent all throughout, but all of a sudden he has been made a criminal with an allegation that Vikash on order of the petitioner assaulted the informant. It is further submitted that it is very easy to implicate someone with an allegation that it was at his behest that the occurrence is committed. It is also submitted that had the petitioner asked Vikash to jump from 25th floor, whether Vikash would have jumped? It is further submitted that petitioner and the informant are related and having dispute relating to property and since petitioner is the Karta of the family, as such he has been implicated in the instant case with a view to coerce the entire family members into submission. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-
