Petitioner apprehends his arrest in connection with Mahila P.S.Case No. 23 of 2017 registered for the offences punishable under Sections 376 and 420 of the Indian Penal Code. Allegation against the petitioner is of forcibly committing sexual intercourse upon the informant.

Submission of learned counsel for the petitioner is that paragraph-8 of the case diary shows that no such occurrence has taken place and, as a matter of fact, there was proposal for marriage in the informant's family and when he did not agree the present case has been lodged.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.11998 of 2018 (3) dt.24-04-2018 2/2 circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and pray for regular bail, which shall be considered on the basis of above submission, With the above observation, this application is disposed of.
