Petitioners apprehend their arrest in connection with Complaint Case No. 1346 of 2017 registered for the offences punishable under Section 420 of the Indian Penal Code. Allegation against the petitioners is of selling land which is not of the petitioners.
Submission of learned counsel for the petitioners is that sale deed has been executed and petitioner No.1 is only witness to the same and mutation has also been made and receipt has also been issued and petitioner No.2 is seller and later on their saying is that the land does not belong to the petitioners, as such the false case has been filed.
Patna High Court Cr.Misc. No.12237 of 2018 (3) dt.24-04-2018 2/2 Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail on the ground that land which has been sold to the informant does not belong to the petitioner and the same does not tally with the description of the land which has been purchased by the informant.
Having heard both sides and in the facts and circumstances, let the petitioners, above named, surrender in the court below within a period of four weeks from the receipt of this order and on their so surrendering they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XI, Gaya, in connection with Complaint Case No. 1346 of 2016, subject to the conditions under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
