2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

3. The case of the prosecution is that the petitioner was having altogether cash of Rs. 8,61,062/- in a bag. He was going on a bike. It is further alleged that two miscreants on a bike looted the bag on gun point. The FIR was lodged against unknown miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. During investigation, Ranjan Yadav and Nand Kishore have given their confessional

Patna High Court CR. MISC. No.84768 of 2024(3) dt.09-04-2025 2/2 statement. The name of this petitioner has surfaced in the confessional statement of Ranjan and Nand Kishore. He also submits nothing was recovered from the possession of the petitioner. No TIP was conducted. It has also been submitted that Ranjan and Nand Kishore have been granted bail by the trial court itself. It is further submitted that the petitioner is languishing in judicial custody since 15.05.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with S.T. Case No. 266 of 2024 P.S. Case No. 572 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judge-III, Saharsa.
