JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2018 The petitioner is apprehending his arrest in connection with Maner P.S. Case No. 497 of 2017, registered for offences punishable under Sections 143, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.
Allegation against the petitioner and others is of assaulting the informant and specific allegation against the petitioner that he assaulted the informant on his head by means of spade, causing injury to him.
It has been submitted on behalf of the petitioner that petitioner that other co-accused against whom there is allegation of assault to the informant has already been granted the privilege of anticipatory bail by this Court vide order dated 03.04.2018 passed in Cr. Misc. No. 12904 of 2018.
Patna High Court Cr.Misc. No.12185 of 2018 (3) dt.25-04-2018 2/2 Heard learned A.P.P. also. He has opposed the prayer for bail that there is allegation against the petitioner that he assaulted the informant on his head by means of spade and opinion on injury has been kept reserved.
Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner, this application is accordingly dismissed.
Let petitioner surrender before the court below and pray for regular bail, which will be considered by the court below on the basis of above submission of learned counsel for the petitioner. (Vinod Kumar Sinha, J) sunil/- U T
