The petitioner has prayed for bail in connection with Gopalganj Town P.S. Case No. 402 of 2019 registered for the offence punishable under sections 399, 402 and 414 of the Indian Penal Code.
As per allegation in the FIR, on receiving secret information, police personnel chased and caught hold of six accused persons including this petitioner who were in a car. It is stated that on search, various articles including the car, various bank documents, ATM cards, PAN card, mobile phone belonging to JIO company etc. was recovered.
It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.81808 of 2019(2) dt.11-12-2019 2/2 that from perusal of the FIR, no incriminating article has been recovered from possession of the petitioner. It is further stated that co-accused Shyam Kumar, from whose pocket a mobile phone of JIO company has been recovered, has been enlarged on bail vide order dated 04.11.2019 passed in Cr. Misc. No. 65465 of 2019. Petitioner is in custody since 23.08.2019, charge sheet has been submitted against him and he has no criminal antecedent.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, specially grant of bail to co-accused, the petitioner being in custody since 23.08.2019, chargesheet having submitted and the petitioner having no criminal antecedent, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 402 of 2019.
