Petitioner apprehends his arrest in connection with Supplementary Spl. (N.D.P.S.) Case No. 13 of 2017, arising out of Forbesganj P.S.Case No. 269 of 2017 registered for the offences punishable under Sections 8/20 (b) (ii) of N.D.P.S. Act. Allegation as per FIR is of recovery of 4 kg. of ganja from the outside house of the petitioner.

Submission of learned counsel for the petitioner is that earlier case has not been found true against the petitioner and final form has been submitted but later on cognizance has been taken against the petitioner and earlier FIR was instituted against son of the petitioner.

Heard learned APP also, who has opposed the prayer for

Patna High Court Cr.Misc. No.18779 of 2018 (3) dt.25-04-2018 2/2 anticipatory bail of the petitioner.

Having heard both sides and in the facts and circumstances, this application is disposed of with direction to the petitioner to surrender in the court below within a period of four weeks from the receipt of this order and pray for regular bail, which shall be considered by the court below on the basis of fact that earlier case has not been found true by the police and after considering the aforesaid fact learned court below will pass appropriate order, if possible, on the same day.
