2. The petitioner seeks regular bail in connection with Forbesganj (Simraha) P.S. Case No. 944 of 2018 for the offences registered under Sections 399, 402, 414, 120(B) of the Indian Penal Code and Sections 25(1-b)a/ 26 of Arms Act.

3. As per the prosecution case, on getting secret information, informant along with other police personnel raided the house of co-accused Anmol Kumar Yadav from where three accused persons, namely Anmol Kumar Yadav, Pawan Kumar Yadav and Amit Kumar Mehta @ Vijay Kumar Mehta were arrested while other two accused persons managed to flee away. They disclosed the name of escaped two accused persons as Ramprit Mehta (Petitioner) and Sudhir Mehta. It is alleged that

4. Learned counsel for the petitioner submits that petitioner was not arrested from the spot. Nothing has been recovered from the possession of the petitioner. He has been implicated in this case due to his criminal antecedent. Petitioner is in custody since 21.08.2023. It is further submitted that similarly situated co-accused, namely, Anmol Yadav @ Anmol Kumar Yadav has been granted bail by a co-ordinate Bench of this Court, vide order dated 20.09.2019 passed in Cr. Misc. No. 44936 of 2019.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Forbesganj (Simraha) P.S.
