Petitioners are apprehending their arrest in connection with Budhha Colony, P.S.Case No.181 of 2019 , registered for offences punishable under Sections 406, 420, 342, 379, 506 and 120(b) of the Indian Penal Code.
As per the FIR, it is alleged that the petitioner was franchise of the company of Dr. Abhijit Paul but no payment was made and later on AMU was signed between the petitioner and Dr. Abhijit Paul and he assured to return the amount of Rs.01 crore and for some time he paid the amount but later on
Patna High Court CR. MISC. No.70274 of 2019(2) dt.07-11-2019 2/3 he refused to pay and when he inquired about the same, he was assaulted in the office.
Submission of the learned counsel for the petitioners is that so far these petitioners are concerned, there is no allegation that any agreement was reached between them and they have falsely been implicated in this case, who happens to be Director and the Secretary of the Company, and even the company has not been made party in this case and even it is believed that whatever allegation is that is against Dr. Abhijit Paul.
Heard learned A.P.P. , who has opposed the prayer for bail on the ground that they are also Director of the Company and as such they are also liable to return the amount. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Judge XVI cum ACJM, Patna in connection with Buddha Colony P.S.Case No.181 of 2019 subject to conditions as laid down
