JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 20-03-2025 Heard Mr. Amarnath Jha, learned counsel for the petitioner, Mr. Dinkar Kumar, learned counsel for the informant and Mr. Sanjay Kumar Pandey, learned APP for the State.
2. The petitioner has prayed for bail in connection with Bangaon P.S. Case No.106 of 2024 registered for the offence punishable under Sections 103(1), 61(2), 54, 351(3) of B.N.S. and Section 27 of the Arms Act.
3. The case of the prosecution is that the father of the informant was getting saved at a saloon. At 3.35 P.M., three miscreants fired at him. He was rushed to Ayush Arnav Nursing Home of Dr. Ajay Singh where he was declared dead. The informant suspects that the petitioner along with others have

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He is languishing in judicial custody since 22.08.2024.

The application for bail is vehemently opposed by learned APP for the State and learned counsel for the informant and submitted that during course of investigation, one Ashish Anand has given his confessional statement and in his confessional statement, he has named Bal Kishan. Bal Kishan has also given his confessional statement. In confessional statement of these two persons, it has come that the petitioner has arranged the main assailant for removing the father of the informant as he wanted to get executed a sale deed of a land and the deceased was the main obstacle. Petitioner is also having criminal antecedent of nine cases. During supervision, it has also come that petitioner has given 10 lakhs to the killers for removing the deceased.
6. Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail at this stage and, as such, his prayer for bail stands rejected.
