2. The petitioner is in custody in connection with Special Case No. 2916 of 2021 arising out of Agamkuan P.S. Case No. 333 of 2021 for the offence punishable under sections 30(a) and 36 of the Bihar Prohibition and Excise Act lodged on 13.04.2021 by the informant, Mukesh Kumar Dubey.
3. As per the prosecution story, the informant alleged that while patrolling, it conducted raid and recovered/seized 20 liters of country-made liquor from ten gallons with 100 Kg soaked mahua flower dug in the ground. This led to the FIR.
4. Learned counsel for the petitioner submits that only because he has enmity with the Police, number of cases have been filed against him and he is fighting the battle.

Learned APP, Mr. Jitendra Kumar Singh on the other hand disputed the same and submits that a bare perusal of the paragraph-3 would show that he has fifteen criminal antecedents and further, the matter is of the year 2021 and he has moved for bail in the year 2024 and in between, number of criminal cases have been lodged against him which clearly shows that he is defying the law.
6. Considering the aforesaid submissions put forwarded by the parties as also the fact that despite the criminal case lodged against him in the year 2021, he continued his criminal activities and even in the year 2024, he has cases under his belt, no relief can be granted to him.
