JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2018 Petitioner apprehends his arrest in connection with Riga P.S.Case No. 185 of 2017 registered for the offences punishable under Sections 467, 468, 471, 419, 420 and 414/34 of the Indian Penal Code.

Allegation as per FIR is that a person was apprehended while he was exchanging ATM from the informant and from his possession two ATM cards were recovered and it is alleged that petitioner was involved in such type of crime and during course of investigation name of petitioner has transpired. Submission of learned counsel for the petitioner is that there is no withdrawal of the amount through ATM by the petitioner and his name transpires in the confessional statement of co-accused and he has no criminal antecedent.

Patna High Court Cr.Misc. No.21941 of 2018 (3) dt.21-06-2018 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. Petitioner to surrender and make prayer for regular bail, which shall be considered by learned court below on its own merit, without being prejudiced by this order and disposed of on the same day, if possible.
