2. The present application has been filed for modification of the order dated 09.09.2025 passed in Cr. Misc. No. 40457 of 2025 by which the petitioner was granted bail in connection with Manihari P.S. Case No. 280 of 2024.

3. Learned counsel for the petitioner submits that the the petitioner was granted bail in connection with Manihari P.S. Case No. 280 of 2024 with the condition that the petitioner be released on bail, "after framing of charge, if not already framed." Learned counsel further submits that the cognizance has already been taken against the petitioner but charge has still

No.81049 of 2025(2) dt.21-11-2025 2/2 not been framed against the petitioner and there is no possibility of framing of charge in near future due to non-appearance of coaccused persons and therefore, the aforesaid condition imposed by this Court while granting bail to the petitioner may be waived off.

4. Considering the submissions made on behalf of the learned counsel for the petitioner and the facts and circumstances, this Court is of the view that no interference in the order dated 09.09.2025 passed in Cr. Misc. No. 40457 of 2025 is required.

5. The learned Trial Court is directed to expedite the process for framing of charges against the petitioner.

6. The modification application is, accordingly, disposed of.
