JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 This is an application for grant of anticipatory bail in connection with Mahua P. S. Case No. 340 of 2018 disclosing offence under Section 304 of the Indian Penal Code. As per F.I.R. petitioner is said to have thrashed the grandson of the informant thrice on the P.C.C. Road, causing injury. He was taken to the hospital and thereafter, to PMCH and grandson of the informant later on succumbed to the injuries.

Submission of the learned counsel for the petitioner is that some of the witnesses during the investigation stated that there was scuffle between the informant and nephew of the informant and when the petitioner went to pacify the same, he has been implicated in this case. There is delay of four days in lodging the F.I.R. Petitioner is in custody for about four months.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Vaishali, Hajipur, in connection with Mahua P. S. Case No. 340 of 2018.
