JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Special Case No. 15 of 2019 arising out of Narpatganj P. S. Case No. 326 of 2019, registered for the offence punishable under Sections 20/22/23 of N.D.P. S. Act.

As per F.I.R. 46 Kg Ganja was recovered from the house of the petitioner.

Submission of the learned counsel for the petitioner is that the seizure list does not show the signature of the petitioner and falsity of the present case will appear from the fact that prior to lodging of the case, the petitioner has lodged a case against S.S.B. personnel for snatching of Rs.1,61,500/- of Nepali currency and the same was released in favour of nephew

Patna High Court CR. MISC. No.70121 of 2019(2) dt.11-12-2019 2/2 of the petitioner later on, which will appear from Annexure-3. He is in custody for six months.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sessions Judge, Araria, in connection with Special Case No. 15 of 2019 arising out of Narpatganj P. S. Case No. 326 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
