2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 8 , 21 , 22 of the Narcotic Drugs and Psychotropic Substances Act. 3 . As per prosecution case , 131 bottles of Codiwell cough syrup (100 ml each) , 9 bottles of Lentexd-C (100 ml each) and 76 Recharge cough syrup (100 ml each) were recovered from the motorcycle of this petitioner.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case . Nothing has been recovered from conscious possession of this petitioner. Petitioner claims clean antecedent. Petitioner is in custody since 20.09.2024 .
5 . Learned counsel for the State opposed the prayer
Patna High Court CR. MISC. No.83509 of 2024(2) dt.24-01-2025 2/2 for bail.
6. Considering the aforesaid facts, period of custody , clean antecedent of this petitioner and other circumstances of the case , prayer for bail of the petitioner is allowed.
7. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Principal Sessions Judge Madhubani in connection with Jainagar Police Station Case No. 123 of 2023 .
