The petitioner apprehends his arrest in connection with Gandhi Maidan P.S. Case No. 369 of 2017 registered under Sections 409, 201 and 120B/34 of the Indian Penal Code. The accusation is that petitioner being Clerk in the Bihar State Road Transport Corporation, Bankipore, Patna, did not deposit the price of diesel Rs.37,491/-, which was taken from the Dipo.
Learned counsel for the petitioner submits that when the petitioner came to known that Rs.37,491/- is shown due against him then he deposited the same after obtaining
Patna High Court Cr.Misc. No.17535 of 2018(4) dt.11-06-2018 2/2 permission from the concerned authorities, which has come in paragraph 12 of the case diary.
Learned A.P.P. fairly submitted that the amount has already been deposited by the petitioner, which has come in paragraph 12 of the case diary.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge-VI-cumA.C.J.M., Patna, in connection with Gandhi Maidan P.S. Case No. 369 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
