2. The petitioner apprehends his arrest in connection with Dhangai P.S. Case No. 14 of 2022 registered under Sections 8(b), 18 and 29 of the N.D.P.S. Act.
3. As per prosecution case, it is alleged that this petitioner along with other accused persons was illegally cultivating the opium on their land or the forest land.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to local dirty politics. Further submission is that petitioner was not found at the place of occurrence. Nothing incriminating article has been recovered from the conscious possession of the petitioner. It is submitted
Patna High Court CR. MISC. No.82694 of 2024(2) dt.27-01-2025 2/2 that petitioner is not the owner of any of the plots or private land which are allegedly used for cultivating opium. FIR has been lodged after a delay of 6 days and there is no plausible explanation for the same. It is further submitted that for the same occurrence, two FIRs were lodged.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, N.D.P.S. Act, Gaya in connection with Dhangai P.S. Case No. 14 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
