2. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act in connection with Sessions Trial No. 178 of 2013 arising out of Srinagar (Pujaha) P.S. Case No. 72 of 2012.

3. The FIR of the occurrence of murder is against unknown. Name of the petitioner has surfaced only on the confessional statement of co-accused persons. Similarly situated co-accused persons, namely, Samir Ansari, Nanhu Yadav @ Nanhe Yadav and Jai Prakash Yadav have already been granted bail by co-ordinate benches of this Court passed in Cr. Misc.

Patna High Court CR. MISC. No.81112 of 2023(3) dt.19-03-2024 2/2 Nos. 29118 of 2018, Cr. Misc. No. 2342 of 2013 and Cr. Misc. No. 48470 of 2012 vide orders dated 16.05.2018, 01.04.2013 and 25.02.2013 respectively.

4. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, Bettiah, West Champaran/Successor court below where the case is pending in connection with Sessions Trial No. 178 of 2013 arising out of Srinagar (Pujaha) Police Station Case No. 72 of 2012, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
