JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-05-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioner seeks bail in a case registered for offence under Sections 341, 323, 447, 302, 504 and 506/34 of the Indian Penal Code.
3. Informant, namely, Khusbhu Devi alleged that on 02.12.2023 at 6 PM, while she was at home, this petitioner entered in the house and started assaulting her and her son Himanshu Chaudhary and also tried to press her neck. Informant further alleged that in the evening, while her husband was returning home, he was ambushed near Garha by all the accused persons including petitioner. The accused persons attacked him
Patna High Court CR. MISC. No.80807 of 2024(3) dt.02-05-2025 2/3 with knife and left him injured, who was later declared dead in the hospital.
4. Learned counsel for the petitioner submits that informant is not eye-witness to the occurrence. This petitioner is pattidar of the informant and because of old land dispute between the parties, petitioner has been made accused in this case. He further submits that in the entire case diary, no material has come against petitioner to show his complicity in the alleged occurrence and only suspicion has been raised against him. Coaccused Sujit Kumar Singh, having similar and identical allegation, has already been granted bail by a coordinate Bench of this Court, vide order dated 11.04.2025 passed in Cr.Misc. No. 81436 of 2024. Petitioner is in custody since 09.09.2024. Chargesheet has been submitted.
5. Learned A.P.P. for the State and learned counsel for the informant opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 598 of 2023 with following conditions:

No.80807 of 2024(3) dt.02-05-2025 3/3 "(i) One of the bailors will be close relative of the petitioner, (ii) Petitioner shall remain present on each and every date before the Court below, as fixed by the trial Court. If continuously on two dates petitioner remains absent, without prior permission of the trial Court, his bail-bond shall liable to be cancelled by the Court below."
