JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2018 The petitioner is apprehending his arrest in connection with Naugachia P.S. Case No. 64 of 2018, registered for offences punishable under Sections 147, 148, 149, 307, 427, 504 and 506 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner is of opening fire upon the informant's cousin causing injury on his chest. Submission of learned counsel for the petitioner is that there is case and counter case in between both parties and the injury report does not show that injury is caused by firearm. Heard learned A.P.P. as well as learned counsel for the informant also, who have opposed the prayer of bail stating that petitioner fired at the informant's cousin and injured was referred to P.M.C.H. and the final injury report has not been obtained.

Patna High Court Cr.Misc. No.47129 of 2018(4) dt.13-09-2018 2/2 Having heard both sides and in view of the facts and circumstances of the case, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, hence, it is rejected.

However, the prayer of regular bail of the petitioner shall be considered by the court below on its own merit without being prejudiced by this order.
