2. Petitioner apprehends his arrest in connection with Itarhi P.S. Case No. 100 of 2023, registered for the offence punishable u/s 365, 366(A), 34 of the IPC and Section 8 of POCSO Act, pending in the court of learned Additional District & Sessions Judge-VI-cum Special Judge-POCSO Act, Buxar.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if petitioner surrenders before the learned

No.81815 of 2023(2) dt.04-01-2024 2/2 Court below within six weeks from today and seeks regular bail, the learned Court below shall pass order on the same day in accordance with law without being prejudiced by this order considering the fact that there is compromise between the parties.
