JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-07-2018 In view of the report which has now been submitted from the office of the Senior Superintendent of Police, Darbhanga, this Court does not find it fit to proceed with this matter.
The report makes it clear that the informant/petitioner had never made any complaint regarding kidnapping of his daughter and in course of inquiry the Police has found from the villagers that the allegation of kidnapping of victim girl by opposite party no. 2 is totally wrong and false and it has transpired in course of inquiry that the petitioner himself had hidden his daughter at Kolkata in the house of his elder daughter and lodged a false complaint case through his wife. Without going into the merit of contentions of the
Patna High Court Cr.Misc. No.20228 of 2018(4) dt.25-07-2018 2/2 parties or giving any observations with regard to what has transpired in course of inquiry, this Court is satisfied that in the facts and circumstances now brought before this Court, no case for cancellation of bail is made out.
This writ application stands dismissed.
It is made clear that if the petitioner has any grievance with respect to the inquiry or any other related matters, no part of the observations recorded hereinabove will come in his way in pursuing his remedy in accordance with law. (Rajeev Ranjan Prasad, J) avin/- U T
