JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-01-2020 Petitioner claims that he is working as Panchayat Secretary after his appointment in 1988 and till date neither any promotion has been granted to him nor benefits of ACP/ MACP have been extended.

2. He is seeking a direction to the respondents to grant benefit of first ACP on completion of 12 years of service, second MACP on completion of 20 years of service and third MACP on completion of 30 years of service.

3. It appears that he has filed a representation to the District Panchayat Raj Officer, Kaimur at Bhabhua, which has been brought on record by way of Annexure-6 to the writ application. It has been stated that the petitioner is going to superannuate in January, 2020.

4. Considering the facts and circumstances, this writ application is disposed of with a direction to the District Panchayat Raj Officer, Kaimur at Bhabhua to consider grant of Assured Career Progression, as is being claimed by the petitioner in the present writ application and take a decision within one month from the date of receipt/ production of a copy of this order. It goes without saying that the determination of pensionary benefits shall be dependent on the revised pay upon grant of ACP, if the same is granted.
