The petitioner is apprehending his arrest in connection with Excise Case No.187 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2016.

As per FIR there is allegation of recovery of liquor from the house of the petitioner and apart from that he is accused in two cases of similar type.

Submission of the learned counsel for the petitioner is that he was not present there and he has been made accused only because of his antecedent.

Heard learned A.P.P. , who has opposed the prayer for bail on the ground of recovery of liquor from his house apart from

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit.

With the aforesaid direction, this application is dismissed.
