Petitioner apprehends his arrest in connection with Complaint Case No. 1393 of 2017 lodged for the offences punishable under Sections 406/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

Allegation as per complaint petition is that marriage was fixed but later on petitioner's side refused to marry sister of the complainant and also there is allegation of Rs.5 lakhs. Submission of learned counsel for the petitioner is that allegation of demand is against Haji Anwar Ali and not against the petitioner and other co-accused has been granted privilege of

Patna High Court Cr.Misc. No.36154 of 2018 (3) dt.30-08-2018 2/2 anticipatory bail by this Court vide order dated 20.7.2018 passed in Cr.Misc.No. 38798 of 2018. Further submission is that while issuing notice to the complainant vide order dated 3.7.2018 petitioner was granted provisional bail.

Heard learned APP and learned counsel for the complainant. They have opposed the prayer for anticipatory bail. Having heard both sides and in the facts and circumstances, the provisional bail granted to the petitioner vide order dated 3.7.2018 by a co-ordinate Bench of this Court is hereby confirmed.
