2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 74, 109(1), 352, 351(2), 329(3) and 3(5) of B.N.S., 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that petitioner on 07.08.2025 at 01:30 a.m. entered her house and started acting inappropriately with her daughter, on alarm, when informant and her husband came, petitioner tried to choke the informant and pushed her husband but was caught. Thereafter petitioner's family members were informant who came and started abusing the informant and her husband.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that petitioner and the informant are agnates and having dispute relating to property. It is also submitted that the victim was medically examined and no external injury was found. It is further submitted that the order impugned records that para-16 of the case diary reflects the injury report of Sandhya Kumari where a cut mark in right cheek has been reported. It is submitted that the learned District & Additional Sessions Judge-V, Lakhisarai got confused while recording the injury. It is submitted that from perusal of the injury report, annexed as Annexure-2 to the anticipatory bail application, it would manifest that the same records Identification Marks- cur mark on right cheek. It is submitted that the identification mark was treated as injury on the face of the victim.
5. Learned APP opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner, let petitioner, above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on

No.76712 of 2025(2) dt.27-11-2025 3/3 anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Barahiya P.S. Case No.163 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
