====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 10-01-2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Shahpur P.S. Case No.344 of 2023, registered for the offences punishable under Section 392 of the Indian Penal Code.

3. As per the prosecution case, three accused persons riding on motorcycle showing katta and pistol looted bags containing Rs.1,02,264/- cash, Mobile, Biometric I. Card, Aadhar Card and Pan Card from informant and his companion when they were returning after collection of money.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case and other two cases on the basis of confessional statement

He further submits that there is no recovery from the possession of petitioner and the petitioner was not put to the test identification parade. He also submits that petitioner is a student aged about 20 years and he is in custody since 13.08.2023.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Bhojpur, Ara in connection with Shahpur P.S. Case No.344 of 2023.
