JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-12-2019 Learned counsel for the petitioner submits that due to reluctance of the wife, the petitioner, despite the order dated 27.09.2019 has not been released.

Considering the above, the order dated 27.09.2019 is modified. The petitioner shall be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhubani, in connection with Khajouli P.S. Case No. 71 of 2016 (G.R. No. 756 of 2016) subject to the condition that both the bailors should be family members.

On release, the petitioner would be under obligation to keep his wife at matrimonial home with full honour and dignity. In the event, the petitioner fails to keep his wife, liberty

Patna High Court CR. MISC. No.74761 of 2019(2) dt.11-12-2019 2/2 shall be available to the opposite party to seek modification of this order.

With the aforesaid, the modification application stands allowed.
