JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-01-2025 Though the present petition has been filed for cancelling the provisional bail granted to the Opposite Party No. 2, by this Court vide order dated 31.01.2023 passed in Criminal Misc. No. 39077 of 2022, however, at the outset, the learned counsel for the petitioner submits that since the mediation has failed, as per the order of this Court dated 31.01.2023, it was incumbent upon the learned Trial Court to have taken a final call with regard to either confirming the provisional bail granted to the petitioner by this Court or revoking the same, however, the learned Court of S.D.J.M., Saran at Chhapra in connection with Saran Mahila P.S. Case No. 19 of 2022, is not passing any order in terms of the aforesaid order of this Court dated 31.01.2023.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the learned Court of S.D.J.M., Saran at Chhapra in connection with Saran Mahila P.S. Case No. 19 of 2022, to pass appropriate orders, after hearing the accused namely, Rupesh Kumar in terms of the directions issued by this Court vide order dated 31.01.2023, passed in Criminal Misc. No. 39077 of 2022, in accordance with law, within a period of four weeks of receipt/production of a copy of this order.

Accordingly, the present petition stands disposed off as not pressed.
