JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Earlier prayer for bail of the petitioner was rejected thrice and this is the fourth attempt on behalf of the petitioner for grant of bail and petitioner is said to be the assailant of the deceased.

Submission of learned counsel for the petitioner is that petitioner is in custody for two and a half years and though charge has been framed in the year 2017 but no witness has been examined as yet.

Heard learned APP also.

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial and try to conclude it as soon as possible, preferably within a period of nine months. At

Patna High Court CR. MISC. No.75084 of 2019(2) dt.05-02-2020 2/2 the same time, the Superintendent of Police, Saran is directed to ensure the presence of the witnesses in court on the date fixed, so that the trial may be concluded within the period specified. This application is, accordingly, dismissed.
