The petitioner seeks bail in Muzaffarpur Sadar P.S. case No. 350/2019 registered under Section 201, 304B/34 of the Indian Penal Code.

The informant, in sum and substance, alleged that his daughter was married with Krishnanandan Rai about five years ago. His daughter got a female child but his daughter was killed and her dead body was cremated.

The learned counsel for the petitioner submits that petitioner is mother-in-law of the deceased. There is no specific allegation of assault or overt act against the petitioner. During the course of investigation, the informant disclosed that her grand daughter, daughter of the deceased, disclosed that Navin Kumar, brother-in-law of the deceased, and Jai Mangal Rai, father-in-law of the deceased, strangulated the deceased to death

Patna High Court CR. MISC. No.71538 of 2019(3) dt.06-03-2020 2/2 and thereafter they took the dead body. The petitioner is in custody since 29.05.2019.

The learned counsel for the informant as well as the learned APP vehemently opposed the prayer for bail but did not dispute the facts that minor daughter of the deceased is said to have disclosed to her maternal grand father that her uncle and grand father killed her mother. She did not make any allegation against the petitioner.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner is mother-in-law of the deceased and she is in custody since 29.05.2019, the petitioner, above named is directed to be enlarged on bail on her furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S. case No. 350/2019.
