JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-12-2019 Appellant seek pre-arrest bail in connection with Kawakol P.S.Case No. 219 of 2019 registered for the offences punishable under Sections 323, 353, 379, 384/34 of the Indian Penal Code and Section 3 (i)(r) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. As per FIR prosecution case is that appellant demanded Rs.1 lac from the informant for completing the work and abused him by taking caste name.

Submission of learned counsel for the appellant is that whole allegation is false and concocted as informant was making illegal demands from the agriculturist for submitting the loss verification report and appellant made protest to the same, as such the present false case has been filed in order to save his

Heard learned Special P.P., who has opposed the prayer for pre-arrest bail of the appellant stating that as per FIR prima facie case is made out against the appellant under the provisions of SC/ST Act.

Having heard both sides and in the facts and circumstances, as stated above, this appeal is disposed of with direction to the appellant to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
