As per Office notes, notice has been personally received by the O.P. No.2 but nobody has entered appearance on his behalf.

The petitioner apprehends his arrest in a case registered for the offence punishable u/s 420, 409 of the IPC. 4.

As per the F.I.R., petitioner being an agent in Hero Financial Limited has collected Rs.3,29,122/- from the customers but has not deposited the same in the Company. 5.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He

Patna High Court CR. MISC. No.84914 of 2023(3) dt.15-05-2024 2/2 has been falsely implicated in this case due to ulterior motive. It is submitted that the petitioner has already deposited the said amount of Rs.3,29,122/- in the Company, which is clear from the receipts enclosed at Annexure-2 series of the bail petition. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. 7.

Having regard to the facts and circumstances of the case, since the petitioner has deposited the amount in question, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Jokehat P.S. Case No.309 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) pallavi/- U T
