JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471, 341, 307, 379, 504, 506, 120B of the Indian Penal Code and 138 of Negotiable Instrument Act.
The present case was instituted on the basis of complaint petition and at Para-6 of the complaint petition the allegation of cheating has been mentioned against the petitioner. Para-6 of the complaint petition says that petitioner as well as her son namely, Prashant Kuamr Jha took near about Rs.10,50000/- from the complainant as well as others in the name of frenchise of Indira Security but learned counsel
Patna High Court Cr.Misc. No.55208 of 2018(4) dt.14-12-2018 2/2 appearing for the petitioner submits that Annexure-2 to this petition goes to show that Indira Security provides platform for those persons , who invest money in share market and the aforesaid Annexure-2 goes to show that the money has been transferred in account of beneficiaries.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate cum Sub-Judge-IV, Patna in Shastrinagar P.S.
