The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 365 and 366 of the Indian Penal Code.
The prosecution case as per the written report of informant Dhruv Sahani submitted to SHO, Motihari Town Police station is to the effect that the informant's minor daughter, namely, Saroj Kumari was kidnapped by Mantu Sahani. It is also alleged that the petitioners being the family members of Mantu Sahani have also assisted him in commission of crime. The victim girl is still traceless.

No.52533 of 2018(4) dt.02-01-2019 2/3 It is submitted by learned counsel for the petitioners that the petitioner nos.1 and 3 are brothers and petitioner no. 2 is the mother of the co-accused Mantu Sahani. It is further submitted that the thrust of accusation is against co-accused Mantu Sahani. A statement has been made in paragraph no. 3 of the petition that the petitioners are not having any criminal antecedent.
Learned APP after going through the case diary submits that the victim girl is still traceless.
Considering the fact that the thrust of accusation is against the co-accused Mantu Sahani and the father of Mantu Sahani has been granted regular bail by a co-ordinate Bench of this Court, vide Cr. Misc. No. 25420 of 2018, coupled with statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran at Motihari in connection with Town (Motihari), P.S. Case No. 717 of 2017, subject
