The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 435, 307, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

There is case and counter case between the parties for land dispute. Though in the FIR allegation is that the petitioner committed arson in the hut of the informant, however, the Investigating Officer did not find any such sign at the time of inspection of the place of occurrence which would be evident from the case diary.

Considering the background and nature of allegation and the statement of the petitioner on oath that he has got no criminal antecedent, let the petitioner, above named, in the event

No.53986 of 2018(3) dt.26-11-2018 2/2 of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Ahiyapur Police Station Case No. 218 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
