JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner apprehends her arrest in connection with Araria P.S. Case No. 454 of 2014 registered for the offences punishable under Sections 147, 149, 384, 406, 420, 120 (B), 467, 468 and 471/34 of the Indian Penal Code. The petitioner is not named in the complaint petition on the basis of which Araria P.S. Case No. 454/2014 was lodged. However, in course of investigation when the restatement of informant was recorded, the informant claimed that the photograph of petitioner was found pasted on application form of the concerned Bank. Learned counsel for the petitioner submits that the entire allegation centers around F.I.R. named accused and
Patna High Court CR. MISC. No.70457 of 2019(5) dt.03-07-2020 2/2 petitioner happens to be mother of co-accused Md. Parwej Alam and Md. Naurej Alam.
He further submits that Md. Parwej Alam and Md. Naurej Alam as well as F.I.R. named accused Bibi Tabassum have already been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner in the event of her arrest/surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Araria in connection with Araria P.S. Case No. 454 of 2014 subject to conditions as laid down under Section 438 (2) of the Cr.P.C. (Hemant Kumar Srivastava, J) GAURAV S./- U
