JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 This application, for grant of anticipatory bail, arises out of Maharajgang P.S. Case No. 228 of 2019, disclosing offences under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.
Allegation against the petitioner is of assault to the informant by means of knife on his head.
Submission of learned counsel for the petitioner is that both the parties are business partners and the allegation is false and concocted and further no sharp cutting injury found on the head of the informant.
Learned counsel for the State opposed the prayer for anticipatory bail and submitted that injury report disclosed that the injury sustained by the informant is grievous in nature.

No.70263 of 2019(2) dt.06-11-2019 2/2 Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
This application is, accordingly, dismissed.
