1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. The petitioners seek regular bail in connection with Muffasil Police Station Case No. 158 of 2020, dated 06.04.2020, disclosing offences punishable under Sections 302/379/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that on 06.04.2020, in the evening, all the accused persons, named in the First Information Report, including the petitioners, came at the door of the informant, with lathi, danda etc. and started abusing him. On objection

No.86731 of 2024(3) dt.20-01-2025 2/3 made by the father of the informant, co-accused Shambhu Nath Singh ordered to kill him and on the said order, all the accused persons assaulted the informant's father by lathi and danda and the petitioners pressed his neck. Coaccused persons also assaulted the mother and father of the informant and when they were taken to the hospital, the father of the informant was declared dead by the doctor.
4. Learned Counsel for the petitioners submits that the deceased was the old uncle of the petitioners, aged about 78-80 years and was suffering from various deceased. There was land dispute between the parties. On the date of occurrence, the deceased fell from his bicycle and succumbed to the injuries and due to land dispute, the petitioners and others have been made accused in this case. He further submits that the petitioners are in custody since 10.08.2024.
5. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that there is specific allegation against the petitioners of pressing the neck of the father of the informant and other co-accused persons assaulted him, leading to his death, I
Patna High Court CR. MISC. No.86731 of 2024(3) dt.20-01-2025 3/3 am not inclined to grant regular bail to the petitioners at this stage.
6. This application is, accordingly, dismissed.
7. However, the petitioners may renew their prayer for bail after five months from today, if the trial does not make any substantial progress.
