1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of regular bail, arises out of Goraul (Kathara O.P.) Police Station Case No. 451 of 2022, dated 12.10.2022, disclosing offences under Sections 420/467/468/471/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that the petitioner, former Principal, Government Primary School, Rampur, Dumri, in collusion with other co-accused persons, have prepared new admission register and produced it before learned Magistrate, Juvenile Justice Board on 23.09.2022 and further, they

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence in the manner alleged. He next submits that the petitioner was merely a teacher of the said school and was not the custodian of the register and/or in-charge of administrative work. He further submits that the similarly situated co-accused Santosh Kumar has been granted regular bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 3255 of 2023. The petitioner is in custody since 12.09.2024.
5. Regards being had to the submissions made by the parties and taking into consideration the period of custody and the fact that the similarly situated co-accused has been granted regular bail by a Co-ordinate Bench of this Court, I am inclined to grant regular bail to the petitioner.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate, Vaishali at Hajipur, in connection to the Goraul (Kathara O.P) Police
