JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-12-2018 Heard Mr. Amrendra Kumar, learned counsel for the petitioner, Mr. Anshuman Singh, learned counsel for the South Bihar Power Supply Distributor Pvt Ltd and the State. The petitioner seeks bail in anticipation of his arrest in connection with Lakhisarai P.S. Case No. 351 of 2018 instituted for the offences under Sections 448, 341, 353, 504, 379, 511, 427/34 of the Indian Penal Code. The petitioner is alleged to have made attempts to loot cash from the cash counter of the Electricity Department and in the process, damaged the show windows. Patna High Court Cr.Misc. No.56543 of 2018(3) dt.10-12-2018 2/2 submitted that in fact the petitioner has also filed a case against the electricity distribution company for having slapped him with an inflated bill without any cause. When this was being negotiated, the employees of the Electricity Company entered into verbal spat and this false case has been instituted.

Regard being had to the fact that petitioner is a valid customer/consumer of electricity and there was a dispute with respect to the settlement of bills, the petitioner, above named, in the event of his arrest or surrender within a period of four weeks from today before the learned Court below, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 351 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
