The petitioner is apprehending his arrest in connection with Mejorgunj P.S. Case No. 105 of 2018 for the offence registered under Sections 385 and 387 of the Indian Penal Code and Section 3 and 4 of the Explosive Substance Act Learned counsel for the petitioner submits that though the petitioner is named in the first information report, his name has been taken on the basis of the statement of one co-accused Rakesh Singh, who was caught at the place of occurrence. It is further submitted that so far as the allegation under Sections 3 & 4 of the Explosive Substance Act is concerned, would not applicable against the petitioner as he was not present at the place of occurrence. It is further submitted that there is no direct
Patna High Court Cr.Misc. No.59705 of 2018(4) dt.13-12-2018 2/2 allegation against the petitioner, save and except, the statement that the petitioner was belonging to one New Kshatriya Sangathan Fauz for which, there is also no evidence against the petitioner.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the learned counsel below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with .Majorgunj P.S. Case No. 105 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that one of the bailors will be his father.
