The petitioner seeks regular bail in connection with Sour Bazar (Patarghat O.P.) P.S.Cas No.494 of 2018 dated 2.9.2018 registered for offences punishable under Sections 341, 323, 379, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and other accused persons is that they tried to enter inside the house of the informant, made indiscriminate firing also and it further appears that he is accused in six other cases also including cases under Sections 392 and 384 of the IPC and the Arms Act. Submission of the learned counsel for the petitioner is that FIR does not disclose that any person received injuries. He has been falsely implicated in this case. He is in custody for five months.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa in connection with Sour Bazar (Patarghat O.P.) P.S.Case No.494 of 2018 with further condition that he has to appear before the local police station of his area for a period of nine months so that his conduct may be watched by the Police. Let a copy of this order be communicated to the Superintendent of Police of the concerned district.. With the above direction, this application is allowed.
