JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-03-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Govindpur P. S. Case No.151 of 2019 registered for the offences punishable under Sections 225(A), 225(B), 201, 188 of the I.P.C. and Section 51/52 of the Bihar Prohibition and Excise Act, 2016.

The petitioner was working as A.S.I. and he seized eight bottles of Indian made foreign liquor from the possession of one Sagar Kumar, but allegedly he left the apprehended accused and only handed over three bottles of Indian made foreign liquor to concerned Officer-in-Charge.

Patna High Court CR. MISC. No.73890 of 2019(3) dt.06-03-2020 2/2 Submission on behalf of the petitioner is that petitioner not only handed over apprehended accused to concerned Officer-in-Charge, but also gave seized eight bottles of Indian made foreign liquor to him.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, (Excise Act), Nawada in connection with Govindpur P. S. Case No.151 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
